Yesterday, the State Board of Education and Ohio Department of Education (ODE) made the proposed amendments to the Ohio Administrative Code (OAC) rule on transportation of students with disabilities (OAC 3301-51-10) available for public comment. ODE has explained that the rule has been amended to remove language found in current federal and state law and to clarify districts’ requirements in this area. The public comment period is open through Feb. 19, 2019.

This transportation rule is part of the operating standards for the education of children with disabilities. The standards identify state and federal requirements that apply to the implementation of special education and related services for Ohio’s students with disabilities. The five-year period for review of the rules ends in 2019. Amendments to the other operating standards will be available for review in early 2019.

In addition to the proposed changes, ODE has prepared a summary of requirements for implementation of the rule. ODE is requesting comments on both the rule and the summary. Public comments can be submitted via email to rulecomments@education.ohio.gov.
