Ohio laws set forth a number of ethical standards for most public officials, including school board members, school district employees and members of school district financial planning and supervision commissions. There are three primary sources of ethical standards that apply to school officials. Ohio Revised Code (RC) Chapter 102 is the Ohio Ethics Law that applies to all public officials. A second source is criminal statutes, such as RC 2921.42 and 2921.43, which are also of general applicability.

While no one is a proponent of school strikes, they are a fact of life for Ohio's public schools. Ohio law specifically allows public school employees to strike, following a proper 10-day notice. However, State Employee Relations Board (SERB) decisions can have an important impact in determining exactly how and when a strike can take place.

Apart from negotiations, arbitrations and unfair labor practice (ULP) charges represent the other primary challenges a district faces regarding employee relations. While arbitrations and ULPs are distinct proceedings, each can have tremendous implications on how a district administers its personnel and costs.
One of the first steps in preparing for negotiations is deciding exactly what needs to be proposed. The best place to start is by reviewing your current collective bargaining agreement. This is the perfect time to look at existing language and update or remove old provisions, add new language that may be required by recent law changes or revise language that just isn't working for the district any more. Also worth considereing is the impact any recent arbitration decisions may have had on the contract or board policy changes that need to be reflected in the contract.

Ohio's compulsory attendance law requires all children between the ages of six and 18 to attend school. Special education laws have extended the right to an education to students with a disability ages three through 21. Ohio's attendance law (RC 3313.64) provides that a child who is at least five, but under 22 years of age, must be admitted to school. In most cases, the child must be admitted to the schools of the district in which his or her parent resides. The law does however provide a list of exceptions to the general rules for entitlement to enroll and attend school tuition-free.

Issues of residence, attendance and tuition, and rights of emancipated minors and adult students often present unique problems for Ohio's public schools. Once a student reaches the age of 18, he/she is an adult in the eyes of the law and acquires the right to consent to release of their school records, sign own permission slips and write excuses for own absences. Emancipated minors are students under the age of 18 who are independent from their parents or other legal guardian.

(Each school district should inform OSBA of the appointment as soon as possible. This appointment should be reflected on the OSBA roster form.)
The school board is ultimately accountable to its citizens for the way schools are governed and managed, and for the results achieved. Ironically, board members often find that little of their time is devoted to the important and difficult job of crafting policy. When we speak about board policy, we speak about ideas with the power to set directions for the schools that will bring about prudent action by the administration, staff and board. The truest thing ever said about policy development is that it never ends.
